Chongqing HKC Optoelectronics Technology’s Large Size Display Panels Again Accused of Infringement: InnoLux Condemns and Brings Additional Patent Infringement Lawsuits Against HKC

<December 16, 2019, Taiwan Miaoli > In the highly competitive large-size TV market, repeat infringer Chongqing HKC Optoelectronics Technology Co., Ltd. (“HKC”)’s display panels are again accused of infringing InnoLux’s patents.
 
On December 10, InnoLux filed three patent infringement lawsuits against more products of HKC in the Shenyang Intermediate People's Court. InnoLux Chairman Jim Hung condemned HKC for its repeating pattern of wanton disregard of others’ intellectual property, and asked the court to issue injunction against HKC’s production and sale of the infringing products and award substantial and adequate damages.
 
On Feb. 12, 2018, InnoLux brought patent infringement lawsuits against HKC in the Guangzhou Intellectual Property Court and the Ningbo Intermediate People's Court. HKC countered by asserting a number of frivolous patent infringement claims against InnoLux. All of the HKC patents were determined to be invalid and HKC’s case was subsequently dismissed in June 2019. In the 20 months since the beginning of litigation, HKC showed a complete lack of good faith to rectify its infringement and continued to reap profits from its pirate behavior.
 
InnoLux Chairman Jim Hung pointed out that InnoLux owns thousands of high quality patents worldwide, covering many aspects of advanced technology, and called out to all companies to compete openly and fairly, with respect to others’ intellectual property.
 
Jim Hung said that the latest lawsuits in the Shenyang Intermediate People's Court involved different HKC products from the previous infringement lawsuits, which indicated that HKC not only continued to produce infringing products, but even its latest-developed products were still pirating proprietary technological advancements of InnoLux. On information and belief, InnoLux had reason to suspect that HKC continued to pirate InnoLux’s star products. InnoLux is continuing to collect evidence and is prepared to take all legal actions necessary.
 
HKC, having been repeatedly accused of its infringement, disregard, and disrespect, has roused the industry for its lawless action. Shenzhen China Star Optoelectronics Technology Co., Ltd. (CSOT) also brought patent infringement lawsuit against HKC in the Shenzhen Intermediate People's Court on April 26, 2019, and accused HKC 23.6 inch, 32 inch, 43 inch, and 50 inch LCD panels – basically all HKC’s mainstream LCD panel sizes – to infringe CSOT’s patents. In mid-November, 2019, the Shenzhen Intermediate People's Court issued a preliminary injunction, ordering HKC to cease production of the products. The decision clearly showed that, in the eyes of the court, HKC’s conduct constituted such a high likelihood of infringement causing irreparable harm to the patent owner, such that granting the extraordinary remedy of injunction was warranted.
 
InnoLux is prepared for head-to-head court battles to defend its reputation and hard-earned technological advancements as well as the rights of InnoLux customers and consumers. InnoLux demands that HKC immediately cease all infringing conduct and all further infringement activities, stop all production of infringing products, abandon all infringing product inventory or manufacturing equipments, and cease all infringing product development.
